TERMS & CONDITIONS

upon booking with narative portraits, you are subject to the following terms and conditions


1. Deposit and Remaining Balance

The Client(s) deposit will be subtracted from the total and the Client(s) will receive an itemized invoice with the remaining balance due on the Gallery due date (outlined in the Client(s) contract agreement). The Client(s) can pay the remaining balance at any point between the Photo Session date and the Gallery due date designated by the Photographer (typically 2-3 weeks after the Photo Session depending on the package). The Client(s) is not entitled to receive their full edited Gallery until the Client(s) pays the remaining balance.


2. Cancellation, Rescheduling, and Tardiness Policy

2.1 Cancellation. The Client(s) may terminate their booking by providing the Photographer with a written notice via email (narativeportraits@gmail.com) no later than [14 days] before the Client(s) scheduled Portrait Session (the “Minimum Notice”). If a written notice of Cancellation is received by Narative Portraits at least 14 days prior to the Client(s) Portrait Session, the Client(s) is entitled to receive a full refund of the Client(s) deposit and the Client(s) will not be obligated to pay the remaining balance. If the Client(s) cancels within 14 days of the Client(s) scheduled Portrait Session, the Client(s) deposit becomes non-refundable and Narative Portraits is not obligated to return their deposit and the Client(s) will not be obligated to pay the remaining balance. In the case of last-minute cancellations made by the Photographer due to unforeseen circumstances, the Client(s) is entitled to a full refund of their deposit and the Client(s) will not be obligated to pay the remaining balance. In the case of group packages, any group members (excluding the group leader, a.k.a the Client) that seek to leave the group must cancel before the Photo Session date with a written notice provided by the Client (a.k.a group leader). The Client is responsible for paying the full remaining balance after the Photo Session date, including the costs of individual group members who decide to drop out after the Photo Session date. The Client may provide written notice of changes in group members to the Photographer 48 hours before the Photo Session and incur no additional costs as long as there are no changes to the group size.


2.2 Rescheduling.

2.2A In the event the Photographer initiates rescheduling, due to inclement weather or extenuating circumstances on the Photographer's side, the Photographer will make every effort to reschedule the Client(s) Portrait Session to a later date or (through communication and permission from the Client(s) to match the Client(s) with a Photographer who can provide the same quality for the same price.


2.2B In the event the Client(s) initiates rescheduling at least 7 days prior to the scheduled Photo Session, the Photographer will use commercially reasonable efforts to accommodate the Client(s) change. If the Photographer is not able to accommodate the Client(s) change despite using commercially reasonable efforts, the parties agree that such Rescheduling will be deemed as Cancellation by the Client(s) and that the Photographer will be under no obligation to perform the Services other than on the original date of the Portrait Session. In this case, Narative Portraits is not obligated to return the deposit and the Client(s) will not be obligated to pay the remaining balance.


2.2C In the case of group packages, it is the responsibility of the Client (a.k.a group leader) to ensure that all group members are available on the rescheduled date to ensure there are no changes to the group size.


2.3 Tardiness.

2.3A By selecting the designated Photo Session date, the Client(s) is committing to be available and on time for the duration of their Photo Session. In the event that the Client(s) arrives late to their scheduled Photo Session, the Photographer is not obligated to extend their end time. For Group packages, all group members are expectedThe Client(s) must make every reasonable effort to communicate in advance if they anticipate running late. The Client(s) is expected to arrive at their Photo Session at least 10 minutes prior to the start time to ensure maximum efficiency and use of the duration of the Photo Session.


2.3B In the case of group packages, it is the responsibility of the Client (a.k.a the group leader) to ensure that all group members arrive at the session on time. The Photographer is not obligated to extend the session time for any group members who arrive late.


2.3C The Client(s) is also expected to join their 30-minute Consultation on time, be attentive for the duration of the Consultation, and prepare their ideas and vision for their Photo Session in advance of their Consultation.


3. Communication Clause

3.1A By booking with Narative Portraits, the Client(s) agrees to respond to email communication from Photographer promptly. Client(s) agrees to complete any necessary documents or forms sent to them and schedule their consultation with their Photographer once requested. In the case of extenuating circumstances, Client(s) will make sure to communicate with Photographer through email, instagram, or text messages.


3.1B Email Communication & Cancellation Policy. Any cancellation or rescheduling requests made by the Client(s) through Instagram or text message must be followed up with an email outlining all details for the request to hold. Cancellation or rescheduling requests made by the Client(s) in accordance to the cancellation & rescheduling policy that is not followed up in writing through email communication to narativeportaits@gmail.com will not hold and Client(s) will no longer be entitled to any refunds.


3.1C Photographer Contact. Client(s) will be able to communicate with Photographer via text message as soon as the booking is confirmed, the deposit is received, and the Terms & Conditions of Booking are signed by the Client(s) and Narative Portraits. Photographer will contact the Client(s) via email for official matters (contract, questionnaires, calendar invites, session reminders, consultation scheduling) and will communicate with the Client(s) via text message for questions, concerns, or reminders.


3.1D Photographer Response Time. Client(s) can expect Photographer to respond within 72-hours response time through email (3 business days) and a 24-hour response time through text message. Client(s) must keep the 72-hour email response time in mind when making a cancellation request through email.


4. Contract Agreements

4.1 Client(s) understand that they will be required to sign a Contract Agreement before receiving any Photographic Services from Narative Portraits. This Contract Agreement is separate from the Terms of Service and outlines all rules of engagement for the Photo Session, Post-Production, payment, and all other matters pertaining to working with Narative Portraits. The Client(s) will receive their Contract Agreement no later than 2 days before their Consultation and will have the opportunity to discuss and negotiate the terms during their Consultation.


4.2 If the Client(s) fails to sign the Contract Agreement, Narative Portraits is not obligated to perform the Photographic Services until the Contract Agreement is signed. Refusal to sign the Contract Agreement after reasonable negotiation with the Photographer will result in a forfeit of the Client(s) deposit in which case, Narative Portraits will not be obligated to complete the Photographic Services and the Client(s) will not be obligated to pay their remaining balance. Any changes to the Contract Agreement made by the Photographer will require a signature from the Client(s) to ensure both parties are on the same page.


5.Display

5.1 The Client(s) hereby allow(s) Narative Portraits LLC to display any digital images covered by this contract on website and social media pages (i.e. Instagram, Facebook, and Linkedin), and physical advertising materials (i.e. promotional flyers and posters) to generally promote the business and provide examples of work to other potential clients.


6. Artistic Release

5.1 Consistency. Photographer will use reasonable efforts to ensure that the Services are produced in a style consistent with Photographer’s current portfolio, and Photographer will use reasonable efforts to consult with Client and incorporate any reasonable suggestions.

5.2 Style. Client acknowledges and agrees that:

  • Client has reviewed Photographer’s previous work and portfolio and has a reasonable expectation that Photographer will perform the Services in a similar style
  • Photographer will use artistic judgement when providing the Services, and shall have final say regarding the aesthetic judgement and artistic quality of the Services; and
  • Disagreement with Photographer’s aesthetic judgement or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.
  • Client will not make any global (colour corrections or any changes to overall image) without written consent of the photography (more in section 7). However, local adjustments such as skin enhancing, removal of blemishes, etc may be permitted at the discretion of the Photographer.
  • Client is discouraged from taking any screenshots of images, as it will reduce the quality. Such lower-quality images would not be an accurate representation of Photographer's work, especially when digital downloads are an option.


7. Ownership of Work Product by Photographer

7.1 Ownership of Work. Photographer will own all right, titles, and interests in all Work Product. Client (on behalf of itself and any participants at the Portrait Session) hereby grants Photographer and any of its service providers an exclusive, royalty-free, worldwide, irrevocable, transferable and sublicensable license to use any materials created by Client or attendees, during the performance of the Services, that may be protected by copyright or any intellectual property rights (“Portrait Session Materials”) as part of any Work Product or in connection with the marketing, advertising or promotion of Photographer’s services, including in connection with Photographer’s studio, portfolio, website or social media, in any format or medium. Client acknowledges and affirms that no other person or entity has any rights that may prevent or restrict Photographer from using Portrait Session Materials as provided herein.

Client agrees that photographs taken during the session can be used by the Photographer for any purpose including, but not limited to, social media marketing, online websites or portfolios, promotional flyers or assets, sale, or any other purpose.


8. Limited License to Client

8.1 Personal Use. Photographer hereby grants Client an exclusive, limited, irrevocable, royalty-free, non-transferable and non-sublicensable license to use Work Product for Client’s Personal Use, provided that Client does not make any global editorial changes and does not remove any attribution notices or copyright notices included by Photographer in any Work Product. “Personal Use” includes, but is not limited to, use (i) of photos on Client’s personal social media pages or profiles; (ii) in Client’s personal creations, such as scrapbooks, albums or personal gifts; (iii) in non-commercial physical display; and (iv) in personal communications, such as family newsletter, email, or holiday card. Client will not make any other use of the Work Product without Photographer’s prior written consent, including but not limited to use of the Work Product for commercial sale. Client agrees to request Photographer's written permission before using photographs for sale or any monetary purposes.
